CGOC Creates a “Sidebar” for Outside Counsel
Forum to Discuss Risks and Responsibilities of Outside Counsel for Corporate Client Legal Holds and Discovery

Mountain View, CA — October 24, 2007 — PSS Systems, pioneers of legal holds and retention management software, announced a new CGOC forum specifically designed to address the significant responsibilities of outside counsel for their corporate clients' legal holds and e-discovery procedures. The CGOC Sidebar is an adjunct forum to the CGOC corporate retention and legal holds practitioners community to focus on the burdens on outside counsel and the tensions between these responsibilities and corporate operational needs. Several high profile cases in 2007 underscore the responsibilities of outside counsel for their clients' practices and make this an extremely timely dialogue.

While outside counsel typically manages a handful of cases at a time, their corporate legal counterparts may be managing thousands of concurrent cases in very complex corporate settings. This complexity may make it challenging for inside counsel to enact all of the guidance or manage the process suggested by outside counsel. The CGOC Sidebar gives outside counsel more insight and information on the operational challenges their corporate clients face; the forum provides guidance and best practices on how to reduce their risks through working more effectively with clients to:

  • understand the client IT environment, data sources, and preservation practices
  • institute and monitor legal holds in the client’s business
  • ensure the client understands and complies with preservation duties
  • audit the client's holds process on an ongoing basis

“Outside counsel has both risk and responsibility for processes and information they don't control and have little transparency to — this is one of the most important focal points across the entire e-discovery arena right now. As a well-established resource for inside counsel to understand their legal holds and retention obligations, CGOC is a natural forum for outside counsel on these same obligations,” said Deidre Paknad, President and CEO of PSS Systems, and founder of the CGOC. “Today, it's incumbent upon outside counsel to ensure that their clients' holds are sufficient through first-hand knowledge which is remarkably complex. The corporate CGOC community combined with PSS Systems' unparalleled experience operationalizing tens of thousand holds provides a tremendous source of knowledge and insight for outside counsel needing to reduce their risks and increase their control and transparency.”

The CGOC Sidebar will host quarterly webinars to discuss best practices for managing the risks and control points related to managing client legal holds and ongoing discovery processes. Corporate legal leaders will provide their points of view on transparency, risk reduction, and increased control. The first will be held October 30th with guest speakers Tom Lahiff, former Assistant General Counsel at Citigroup and Deidre Paknad, President and CEO of PSS Systems. The first CGOC Sidebar event, “Reduce Your Risk & Increase Your Control”, intended specifically for outside counsel will take place at 12:30pm eastern standard time.
